Administrative and Public Law

We have extensive experience in the most varied issues involving Administrative and Public Law, advising national and foreign clients in their relations with bodies of the direct and indirect administration, municipal entities, public companies, mixed-capital companies and public foundations.

Our work is divided into two aspects, consultive and litigation, and comprises the following services:

CONSULTING 
  • Assistance in bids and contracts before bodies of the direct and indirect administration;
  • Assistance on obtaining records, authorizations, and defenses in administrative proceedings before federal, state and municipal regulatory agencies;
  • Preparation, analysis and monitoring of administrative contracts, agreements and other negotiating terms signed with the bodies of the direct and indirect public administration; as well as contractual claims for economic and financial rebalancing;
  • Legal advice to state-owned companies in their interface with the Government and the private sector;
  • Support in consensual dispute resolution procedures, with emphasis on: Terms of Conduct Adjustment (TAC), mediations and composition of dispute boards. dispute boards.

DISPUTES IN THE ADMINISTRATIVE AND JUDICIAL SPHERE
  • Assistance on the presentation of challenges and administrative defenses and monitoring of judgments in the scope of bids;
  • Assistance on disciplinary administrative proceedings (PAD), administrative accountability proceedings (PAR), administrative appeals and other administrative litigation measures in general;
  • Acting with the Courts of Auditors (municipal, state, and federal) and other control bodies (Comptroller General's Office – CGU, Public Prosecutor's Office, etc.);
  • Defense of administrative acts and contracts and sponsorship of the interests of clients in: proceedings brought in the context of the audit courts (representation, complaint, accountability, special accountability, etc.), administrative misconduct actions and other proceedings related to specialized administrative and judicial litigation;
  • Defense in sanctioning administrative proceedings before the Central Bank of Brazil (Bacen) and the National Financial System Appeals Board (CRSFN).
