Flavio Martins Rodrigues and Thiago Araújo comment on the TCU’s decision authorising the launch of audit proceedings into schemes administered by EFPC

An article in *Investidor Institucional* magazine highlighted that, in a recent decision, the Federal Court of Auditors (TCU) authorised the launch of audit proceedings into pension schemes administered by Closed Supplementary Pension Entities (EFPCs) sponsored by federal public bodies and companies. The Court, however, did not specify which schemes and entities will be audited.

According to our partners Flavio Martins Rodrigues and Thiago Araújo, there is an overlap between the TCU’s remit and the legal powers of the National Superintendency for Supplementary Pensions (Previc) and, in light of the new ruling by the audit body, pension entities must be prepared to provide the Court with detailed and clear explanations in order to avoid fines and the imposition of compensation claims against their directors.
