Chaired by Flavio Martins Rodrigues, the OAB/RJ’s Public Social Security Commission delivered a project to the president of the Section, Ana Tereza Basilio, aimed at de-judicializing Brazil’s public social security system.
The bottleneck created by excessive judicialization materializes in a long “INSS queue” which has direct consequences for the lives of insured people, as well as overloading the Judiciary and burdening the Public Administration.
Given this scenario, the Commission carried out a technical study to analyze domestic and international experiences and propose improvements to the administrative process.
The preliminary proposals seek to make the process faster, clearer and safer for the population. One of the suggestions is to expand the role of lawyers in administrative proceedings, before cases reach the courts.
