The proceedings, which began in April, are assessing whether Enel has definitively rectified shortcomings and breaches relating to the restoration of power supply following outages in emergency situations.
According to the board of the National Electric Energy Agency (Aneel), the distributor’s performance fell below the average of other concessionaires during extreme weather events in 2023, 2024 and 2025, which affected millions of consumers in 24 municipalities in the São Paulo metropolitan area.
In Luiz’s view, the situation is heading towards a recommendation by Aneel that the concession be revoked. “But there has never been an actual revocation of a distribution concession in Brazil, so the final outcome depends on a political decision by the Ministry of Mines and Energy (MME); it is not automatic.”
