Our lawyer Pedro Diniz da Silva Oliveira has published an article on the Migalhas website regarding the ruling on Issue 24 by the Superior Labour Court (TST), which held that the Labour Courts lack jurisdiction to adjudicate on management decisions made by closed supplementary pension schemes.
In the article, Pedro analyses the TST’s decision, highlighting its institutional importance, as it concerns the demarcation between the substantive jurisdiction of the Labour Courts and the Ordinary Courts, in light of the constitutional autonomy of the supplementary pension scheme and the established case law of the Federal Supreme Court.
