Our partner Flavio Martins Rodrigues and our attorneys Larissa K. Vieira Bosco and Bruno Ballogh are the authors of the article “Closed Supplementary Pension Plans: the necessary regulatory simplification,” published in the collection “Supplementary Pension Plans: the transformative role in social inclusion and protection: trends, challenges, and opportunities,” launched during the 46th Brazilian Private Pension Plan Congress (CBPP), held at the end of October in São Paulo.

The book brings together contributions from some of the leading experts in the sector in Brazil who, from different perspectives, enrich our knowledge of supplementary pensions and reflect on the paths that lie ahead for their future.

The articles cover a wide range of topics. Some reflect on the role of the ESG agenda and how it influences pension fund management, reinforcing the idea that sustainability should be a structural pillar of these entities. Others explore the regulatory segmentation of EFPCs, highlighting the impacts of proportionality on risk-based supervision and the balance between security and efficiency. The book also highlights analyses of complex legal issues, such as the interpretation of STJ Theme 1224, the controversies surrounding the split of pension plans, and the implications of migration between plans, issues that require legal certainty for the protection of participants and sponsors. Finally, two other themes addressed in the book are reflections on innovation and technology and a strong concern with the social function of closed supplementary pension entities.
