Our lawyer, Ana Luiza Moerbeck, has published an article on the Migalhas website on the challenges of regulating digital platforms in the context of disinformation.
The article analyses the current situation in Brazil and highlights how the absence of legislative action has led various institutions – including the judiciary, the executive, the electoral justice system and the platforms themselves – to devise their own responses to the issue.
According to Ana Luiza, “legislating on digital platforms carries political costs: it means establishing limits and obligations in an environment that has become central to political activity itself. But failing to decide also has a cost. Not legislating is also a response, with consequences of its own”.
